Terms of Service

These terms govern your use of Marta, the direct-to-consumer service of Commercialy, Inc., a licensed Arizona insurance agency. By using Marta, you agree to them.
01What Marta is
Marta is a service of Commercialy, Inc., a licensed insurance agency (Arizona license #3001332856, NPN 19935702). We are an insurance agency, not an insurance company. Coverage is underwritten and issued by the insurance carriers you choose; those carriers — not us — decide whether to offer coverage and on what terms.
02Eligibility
You must be at least 18 years old and located in a state where we're licensed to use Marta to obtain coverage. We currently operate in Arizona. You agree to give accurate, complete information and to keep it current.
03Quotes and estimates are not a contract of insurance
Any number shown before you provide the required consents is an estimate, not a final price or an offer of coverage. Verified prices depend on information obtained from carriers and consumer-reporting providers. You are not covered until a carrier issues a policy and any required payment is made. Prices, availability, and terms can change based on underwriting.
04AI assistant and the licensed-human review
Marta is an AI assistant and always identifies as one. Marta helps you understand options and drafts advice, but a licensed producer reviews and approves before you're bound — Miguel Torres, Arizona license #20652103. Marta does not bind coverage on her own. AI-generated explanations may occasionally be incomplete or inaccurate; the terms of the actual policy issued by the carrier control, and you can always ask to speak with a licensed agent.
05Your authorizations and electronic signature
To serve you, we ask you to authorize specific actions — gathering your information, obtaining consumer reports under the FCRA, optional text messaging, and signing electronically. You consent to transact and sign electronically under E-SIGN and Arizona's UETA, and to receive disclosures electronically. Documents you sign with us are sealed and tamper-evident, with an auditable record.
06Switch Concierge
If you ask us to help replace existing coverage, you authorize us to prepare and submit a cancellation request (such as an ACORD 35) to your prior carrier effective no earlier than your new coverage begins. You're responsible for confirming that replacement coverage is in force before any prior policy is cancelled.
07Communications
By providing your contact information, you agree we may contact you about your quotes and policies. If you opt in to text messages, message and data rates may apply; reply STOP to opt out. Consent to texts is not a condition of purchase.
08Acceptable use
Use Marta only for lawful purposes and for your own insurance needs. Don't misuse the service, attempt to access it in unauthorized ways, submit false information, or infringe others' rights. We may suspend access for misuse.
09Intellectual property
Marta, the Commercialy name, and the content and software behind the service are owned by Commercialy, Inc. or its licensors. We grant you a limited, personal, non-transferable right to use the service. Documents we prepare for you (such as your signed forms and evidence of insurance) are yours to keep and use.
10Disclaimers
The service is provided "as is." We don't guarantee that any particular coverage, price, or carrier will be available to you, or that estimates will match final carrier pricing. We work to keep the service accurate and available but don't warrant that it will be uninterrupted or error-free.
11Limitation of liability
To the fullest extent permitted by law, Commercialy, Inc. will not be liable for indirect, incidental, special, or consequential damages arising from your use of the service. Nothing in these terms limits any liability that cannot be limited under applicable law, or affects your rights under an insurance policy issued to you.
12Insurance regulation and complaints
As a licensed agency, we're regulated by the Arizona Department of Insurance and Financial Institutions. You can verify our license or file a complaint with that department. Nothing in these terms waives any right you have under Arizona insurance law.
13Governing law and disputes
These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Disputes will be handled in the state or federal courts located in Arizona, unless applicable law provides otherwise.
14Changes to these terms
We may update these terms as the service evolves. We'll revise the effective date above and, for material changes, provide additional notice. Continuing to use Marta after an update means you accept the revised terms.
